Model Release Agreement
This Model Release Agreement (“Agreement”) is made and entered into by and between DangerVerse, doing business as DangerGirlx (“Photographer”), and the model (“Model”) who is signing this document. By signing this Agreement, you, the Model, agree to the terms and conditions outlined below.
Grant of Rights
As the Model, you hereby grant DangerVerse the absolute and irrevocable right and unrestricted permission concerning any photographs, videos, or other audio-visual content that the Photographer has taken or may take of you or in which you may be included with others. This includes the following rights:
- Usage Rights: DangerVerse is granted the right to use, reuse, publish, and republish the content in whole or in part, individually or in conjunction with other photographs, videos, or audio-visual content. This usage may be in any and all media now or hereafter known, including but not limited to the website, social media, promotional materials, advertisements, and other forms of communication.
- Modification Rights: DangerVerse may alter, edit, crop, and retouch the content at their discretion. This includes combining the content with other images, text, and graphics without restriction.
- Commercial Rights: DangerVerse has the commercial rights to the photographs and other content, including the right to print and sell them as they please.
- Transfer Rights: The rights granted in this Agreement may be transferred and assigned by DangerVerse to any third party without further consent from the Model.
- Creative Content Rights: DangerVerse may use the content to create stories, including but not limited to erotica and other narrative forms. This includes the right to create characters and stories based on the Model. The company has full creative rights to write stories as long as it is not illegal to do so. By signing this contract, the Model grants permission to create stories and characters around the Model.
Compensation
The Model acknowledges and agrees that the compensation for this Agreement is detailed and agreed upon separately. Compensation may include monetary payment, copies of the photographs, credit in publications, or other mutually agreed-upon benefits. The Model agrees that no further compensation is due once the agreed-upon terms are met.
Model’s Representations and Warranties
The Model represents and warrants that:
- Legal Age: The Model is of legal age in the jurisdiction in which this Agreement is executed and has the full legal capacity to enter into this Agreement. If the Model is a minor, a parent or legal guardian must sign this Agreement on the Model’s behalf.
- No Conflicts: The Model’s appearance in the photographs, videos, or other content does not violate any law or the rights of any third party, and the Model is not bound by any exclusive contract or agreement with another party that would prevent them from entering into this Agreement.
- Voluntary Participation: The Model is voluntarily participating in the photo shoot or video session and agrees to adhere to the guidelines and instructions provided by DangerVerse during the production process.
Release and Waiver
The Model hereby releases and discharges DangerVerse and its representatives, licensees, successors, and assigns from any and all claims, demands, actions, or causes of action which the Model may have by reason of this Agreement or the use of the photographs, videos, or other content.
Indemnification
The Model agrees to indemnify and hold harmless DangerVerse, its representatives, licensees, successors, and assigns from and against any and all losses, damages, liabilities, claims, costs, and expenses (including reasonable attorney’s fees) arising out of or resulting from any breach of the Model’s representations, warranties, or obligations under this Agreement.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which DangerVerse operates, without regard to its conflict of law principles.
Entire Agreement
This Agreement constitutes the entire understanding and agreement between the parties with respect to its subject matter and supersedes all prior agreements, negotiations, and discussions between the parties.
Amendment
This Agreement may not be amended or modified except in writing signed by both parties.
Signatures
By downloading and signing the Model Release Agreement, the parties acknowledge that they have read and understand this Agreement and agree to be bound by its terms.
